One of the changes in family law in our life time is about happen! After 30 years of campaigning the requirement to cite your spouse’s conduct, or bad behaviour will become history! You can now dissolve your marriage by saying that you have ‘drifted’ apart, want different things in life etc.
On Wednesday 6 April 2022 the Divorce, Dissolution and Separation Act 2020 will allow couples to make a joint application for divorce. The changes to the law aim to remove the element of ‘fault’ and minimise conflict between parties. We are hopeful that removing blame will enable couples to reduce conflict when they address matters concerning children, property and finances.
If you have already submitted a divorce application, do not worry, your application will not be affected. All divorce applications from the 6th April will proceed under the new legislation.
In order for the new digital system to ‘bed in’ the court will not be processing new divorce applications, online, between 31 March and 6 April. If your application is urgent a paper application can be submitted.
