In October 2021, some of the rules governing the procedure in family cases changed. Two significant changes were introduced with the intention of making family law proceedings more accessible.

 

One of the changes provides that the court shall automatically consider a person who has been, or is likely to be, a victim of domestic violence as eligible for the making of a ‘special measures’ direction. For such individuals, it is expected that the standard of evidence provided by them and their participation in proceedings is likely to be diminished as a result of their vulnerability.

 

In reforming the Rules to automatically consider domestic violence victims as eligible for these measures, it is hoped that the court process will become easier and victims will feel supported.

 

A further significant change in the rules is that ‘legal bloggers’ will now have the same access to specified family proceedings, which are usually held privately, as accredited media representatives currently have. With a significant increase in online blogs and information sites since the pandemic, it is hoped that this amendment will increase engagement and understanding of the legal process via more accessible means.
