They are two of Hollywood’s most famous stars, however, even Brad Pitt and Angelina Jolie have failed to agree the principles of co-parenting following the breakdown of their marriage in 2016.

 

Although the grounds of divorce are slightly different in the US compared to the UK (Jolie used “irreconcilable differences” as her fact to prove the irretrievable breakdown of the marriage), the process for formalising custody arrangements for the children of separated parents is incredibly similar.

 

Child services professionals interviewed the five dependent Jolie-Pitt children and submitted to the Court safeguarding reports and welfare recommendations much in the same way as CAFCASS does in this country.

 

The ruling made in Brad Pitt’s favour overturns a previously imposed Customary Order, significantly increasing the amount of time he can spend with the children.

 

The award of Joint Custody translates as a Shared Care Order in this country, whereby a Child Arrangements Order would confirm parental responsibility is shared by both parents equally. This follows an emerging pattern of judicial thinking in the UK where Family Courts are moving away from identifying a primary carer, instead promoting shared care of children at every opportunity.
